Dear Boulder County Commissioners, I insist that you use everything within your power to stop this project entirely, including exercising your 1041 regulations to the maximum. I recognize you feel that you do not have the legal authority to stop the project with your 1041 powers because of a belief that the federal permit (issued by FERC) pre-empts your local 1041 authority. Despite this belief of yours, I insist that you take the risk and exercise your 1041 authority to stop the project. To date, the county is not taking into full consideration the true impact of this project. Though there are countless issues that will negatively affect citizens of Boulder County which have not even been mentioned in this draft IGA, I am personally primarily concerned with the following:

However, given the ridiculously short time-frame with which you are giving us to comment on this draft IGA, I would guess that an additional $20 Million added to the IGA as “compensation to citizens affected by project construction impacts” may come close to effectively addressing most of these issues. Proactively preparing for the tremendous burden of these impacts by negotiating the highest dollar amount from Denver Water now will allow the county the greatest chance of avoiding Land Use lawsuits initiated by citizens like myself. Additionally, it is imperative that the wording on the draft IGA in paragraph 4.3 be reversed to prioritize citizen impacts over Open Space acquisition so that I am not pitted against my own desire for Boulder County to acquire additional Open Space.
